Greenwashing and the Rise of Green-Hushing

SPE WA is pleased to announce our joint-society meeting arranged in conjunction with ERL (Energy & Resources Law) and AIEN (Association of International Energy Negotiators).  Our speaker will be John Zadkovich, Partner of Penningtons Manches Cooper, who will deliver an informative and engaging talk on the hot topic on greenwashing and the rising of green-hushing.

About the Presentation

The ESG matrix continues to expand with a myriad of legal and regulatory considerations for companies operating in the energy sector, among others. It is at times measured, at others – to quote those in the industry – ‘tedious’ and ‘onerous’.

Certain of the ESG indices are laudable because of the benefits they bring, relevantly mitigating the risk of greenwashing and engendering a more sustainable environment. However, there is an increasing countereffect, ‘green-hushing’, whereby companies deliberately downplay their environmental/green credentials or simply keep them confidential.

This presentation touches on the current regulatory environment for greenwashing, covering certain jurisdictions, looks at the pros and cons of green-hushing, and offers some practical tips.

About the Speaker – John Zadkovich

John advises on a range of energy, trade and finance matters, with particular expertise in international commercial arbitration, investigations and public international law.

He has a strong legal and commercial understanding of the trade, energy (including oil and gas, mining/natural resources, renewables), infrastructure and finance sectors. John is experienced in working with most international arbitration rules and recognised institutions, including ICC, LCIA, SIAC, LMAA, HKIAC, CIETAC and UNCITRAL, and frequently appears as counsel before arbitral tribunals. He has also advised clients regarding regulatory and internal investigations and appeared as counsel.

John’s clients range from sovereign states, state owned entities, and multinational and domestic companies, to trading houses, private equity firms and family offices. He has nearly 20 years of legal experience across Asia-Pacific, Europe and the Middle East, having previously worked at Australian, English and American law firms, including six years in Hong Kong.
